Location: Melbourne and Mount William Station, Western Victoria

These terms and conditions ("Terms") govern your participation in the Mount William Executive Program ("Program") organised by Future Ink Pty Ltd ("Organiser").

1. Participation Requirements

1.1 Health and Safety: You must disclose any medical conditions that may affect your participation in Program activities and travel arrangements.

1.2 Insurance: You are encouraged to obtain your own travel and medical insurance to cover risks associated with your participation in the Program.

2. Payment Terms

2.1 Deposit: A non-refundable deposit of 50% of the total Program fee is required to secure your place in the Program. This deposit must be paid upon registration.

2.2 Final Payment: The remaining balance must be paid no later than 16 February 2026.

2.3 Refund Policy: Payments are non-refundable. Given the exclusive nature of the Program and the desire to have a spread of suitably qualified participants across sectors and organisation types, it may not be possible for the Organiser to replace you with another participant. However, if a replacement is found and registered, the Organiser will refund your payments less any administration fees.

3. Cancellation and Modification by the Organiser

3.1 Cancellation or Modification: The Organiser reserves the right to cancel or modify the Program in circumstances where it cannot be conducted as planned, including but not limited to issues with venues, or other unforeseen events.

3.2 Refund or Alternative: In the event of cancellation by the Organiser, you will have the option to attend the Program as varied or receive a full refund of payments made. The Organiser will not be responsible for any other costs already incurred by you, such as travel expenses.

4. Liability Waiver and Indemnity

4.1 Statutory Guarantees: Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other condition, implied or imposed by the Australian Consumer Law (“ACL”) or any other applicable legislation which cannot be lawfully excluded or limited. Our liability for a failure to comply with a guarantee under the ACL (other than a guarantee implied by s.51, s.52 or s.53 of the ACL) is limited, to the maximum extent permitted by law, at our option, to resupply of the services or payment of the cost of having the services resupplied. To the extent permitted by law, all other guarantees, conditions or warranties are excluded.

4.2 Liability Waiver: To the fullest extent permitted by law, you waive, release and discharge the Organiser, its officers, affiliates, employees, agents, contractors, and any other related parties (collectively referred to as the "Released Parties") from any and all liability, claims, demands, actions or causes of action (collectively referred to as "Claims") that may arise from or relate to any loss, damage, injury, illness or death you sustain in connection with your participation in the Program, whether caused by the negligence, breach of contract, breach of statutory duty, or otherwise by the Released Parties.

4.3 Indemnity: You agree to indemnify and hold harmless the Released Parties from and against all Claims, costs or expenses (including legal fees) that the Released Parties may incur or suffer as a result of or arising out of:

(a) your participation in the Program; and

(b) any breach by you of these Terms.

4.4 No Liability for Third-Party Providers: The Organiser is not liable for any acts, omissions, or defaults of any third-party providers engaged to assist with the Program, including but not limited to transportation, accommodation, or activity providers. You acknowledge that third-party providers operate under their own terms and conditions, and any claims arising from their services must be directed to those providers.

4.5 Limitation of Liability: To the maximum extent permitted by law, the Released Parties’ total liability to the Participant for any Claims arising out of or in connection with the Program, whether arising in contract, tort (including negligence), or otherwise, shall not exceed the total fees you paid for the Program. The Released Parties shall not be liable for any indirect, consequential, incidental, special, or exemplary damages, including but not limited to loss of profits, loss of enjoyment, or any other non-monetary loss.

5. Conduct and Behaviour

5.1 Conduct: Participants are expected to conduct themselves professionally and respectfully towards all participants, Organiser employees or representatives, and third parties involved in the Program and comply with any relevant third-party policies.

6. Travel and Accommodation

6.1 Accommodation and travel to and from Mount William Station: Accommodation during the Program, and return minivan charter from Melbourne to Mount William Station, is included.

6.2 Travel to and from Melbourne: You are responsible for arranging and covering the cost of your own travel to and from Melbourne. The Organiser is not liable for any travel-related delays or cancellations.

7. Force Majeure

7.1 The Organiser shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, strikes, war, or public health emergencies.

8. Confidentiality and Non-Disclosure

8.1 During the Program, you may disclose information of a confidential or personal nature, and you and the Organiser may be exposed to confidential or personal information of other participants. You and the Organiser agree not to disclose or use any such confidential or personal information for any purpose outside the scope of the Program without the express written consent of the disclosing party.

9. Acknowledgment and Agreement

9.1 By signing below, or by registering and participating in the Program, the Participant acknowledges that they have read, understood, and agree to be bound by these Terms.
